  • Before: R. Labelle
  • Appearances: A. Zajchowski, for the Grievor; J. Bélanger, for the Employer
  • Decision Rendered: 1997-04-11

An application for judicial review before the Federal Court has been allowed (Court file: T-910-97).

Subject terms:

Jurisdiction - Job description - Section 7 of the Public Service Staff Relations Act - relevant provision of collective agreement specified that an employee was entitled to "a complete and current statement of the duties and responsibilities of his position" - grievor claimed that the work performed by her as of January 1, 1994, was not accurately reflected in her job description - employer submitted that adjudicator lacked jurisdiction to entertain this grievance as it violated section 7 of the Public Service Staff Relations Act (PSSRA) - adjudicator concluded that he had jurisdiction as grievance related to the interpretation of the collective agreement and not to classification or the assignment of duties to positions contrary to section 7 of the PSSRA - evidence failed to support grievor's allegation that she was required to perform duties which were not reflected in her job description.

Grievance denied.
